These Website Terms & Conditions (“Terms”) apply to the use of the Jumpbooster website and to products and services purchased from Jumpbooster through this website.

Jumpbooster is a registered business name of Marxgold Investments Pty Ltd (ABN 32 104 901 751) (“Jumpbooster”, “we”, “us” or “our”).

By using this website or placing an order with Jumpbooster, you agree to these Terms. If you purchase a product from us, the Terms applying at the time your order is placed will form part of the agreement between you and Jumpbooster.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL) or any other applicable law.

1. USING THE JUMPBOOSTER WEBSITE

You may use this website for lawful purposes, including browsing our products, obtaining product information, using our product-selection tools, contacting us and purchasing products.

You must not use the website in a way that:

  • breaches any applicable law
  • interferes with the security or operation of the website
  • attempts to gain unauthorised access to our systems or accounts
  • introduces malicious software or harmful code
  • infringes the rights of Jumpbooster or another person
  • uses automated systems to improperly extract or interfere with website information.

We may restrict access to the website where reasonably necessary for security, maintenance, fraud prevention or legal compliance.

2. PRODUCT INFORMATION

We aim to provide accurate descriptions, specifications, photographs and other information about products offered through our website.

Product specifications may change from time to time as products are improved or manufacturers and suppliers update their products.

Images are intended to represent the product as accurately as reasonably possible but may occasionally show accessories, packaging or other items that are not included unless specifically stated.

Before purchasing, please review the product description, specifications, voltage, capacity, compatibility and intended application.

If a specification or feature is particularly important to your intended use, please contact Jumpbooster before purchasing so we can confirm the current product specification.

3. PRODUCT SUITABILITY

Different vehicles, engines, batteries, machinery and electrical systems can have significantly different starting and power requirements.

Customers should select products suitable for the intended:

  • system voltage
  • engine or equipment type
  • starting requirements
  • operating environment
  • duty cycle
  • application.

Where you tell Jumpbooster the particular purpose for which you require a product and reasonably rely on our advice, your rights under the Australian Consumer Law may include a guarantee that the product is fit for that disclosed purpose.

If you are uncertain about product suitability, we encourage you to contact Jumpbooster before purchasing.

4. JUMP STARTER FINDER

The Jump Starter Finder is designed to assist customers in identifying potentially suitable Jumpbooster products.

Recommendations are generated using information you provide about your vehicle, equipment and starting requirements together with automated scoring and product-selection rules.

The accuracy of a recommendation depends on the accuracy and completeness of the information provided.

The Finder is intended as a product-selection aid. If your application is unusual, particularly demanding or you are uncertain about a recommendation, please contact Jumpbooster before purchasing.

Use of the Finder does not limit any rights you may have under the Australian Consumer Law.

5. SAFE AND CORRECT PRODUCT USE

Products must be used in accordance with their instructions, specifications and intended purpose.

This includes using the correct:

  • voltage
  • polarity
  • connection method
  • charging equipment
  • cables and connectors
  • operating procedure.

Customers should read the supplied instructions before using a product.

Incorrect connection, modification, inappropriate charging, excessive loading, physical abuse or use outside a product’s intended specifications may cause product or equipment damage and may affect eligibility under a voluntary warranty.

This does not exclude any rights that cannot lawfully be excluded under the Australian Consumer Law.

6. PRICES

Unless clearly stated otherwise, retail prices displayed on the Jumpbooster website are in Australian dollars (AUD) and include GST where applicable.

Delivery or freight charges may be additional and will normally be displayed at checkout or otherwise advised before the order is completed.

We may change prices from time to time. A price change does not affect an order that we have already accepted unless otherwise agreed with you or required by law.

7. PRICING OR WEBSITE ERRORS

We take reasonable care to ensure prices and product information are correct.

If an obvious pricing, description or technical error is identified before an order is accepted or dispatched, we may contact you to explain the error and give you the option of proceeding on the corrected basis or cancelling the affected item.

If we cannot supply an item at the advertised price because of a genuine error and the order is cancelled, any amount already paid for that item will be refunded.

Nothing in this clause permits Jumpbooster to engage in misleading pricing or advertising practices.

8. PLACING AN ORDER

Submitting an order through the website is an offer by you to purchase the products shown in your order.

An automated order confirmation acknowledges that we have received your order but does not necessarily mean the order has been accepted.

An order is generally accepted when we confirm acceptance, commence fulfilment or dispatch the goods.

We may contact you if we need further information before accepting an order.

9. AVAILABILITY

All products are subject to availability.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably practical.

Where appropriate, we may offer:

  • a suitable alternative product
  • a backorder or delayed delivery
  • cancellation of the affected item and a refund.

We will not substitute a materially different product without your agreement.

10. PAYMENT

Payment must be made using one of the payment methods offered at checkout or otherwise agreed with Jumpbooster.

Orders may not be dispatched until required payment has been received or authorised.

Payment processing may be performed by third-party payment providers and may also be subject to their terms and privacy practices.

Jumpbooster does not generally receive or store complete credit or debit card details processed by third-party payment providers.

11. DELIVERY

We deliver products using third-party freight, courier and postal services.

Delivery charges and available delivery methods may depend on:

  • destination
  • product size and weight
  • dangerous-goods or battery transport requirements
  • delivery service availability.

Any delivery date or transit time provided is an estimate unless expressly agreed otherwise.

We will take reasonable steps to dispatch orders promptly, but delivery can sometimes be affected by circumstances outside our reasonable control.

If there is a significant delay or a product cannot be supplied within a reasonable time, please contact us so we can work with you on an appropriate solution.

12. DELIVERY INFORMATION

You are responsible for providing an accurate delivery address and reasonable delivery instructions.

Additional costs caused by incorrect or incomplete delivery information may be charged where those costs were reasonably incurred and the circumstances were within your control.

If a parcel appears lost or damaged in transit, contact Jumpbooster as soon as reasonably possible so we can investigate the matter with the carrier.

13. TITLE AND RISK

Ownership of goods passes to you once Jumpbooster has received full payment for those goods.

For ordinary customer deliveries, risk in the goods generally passes when they are delivered to you or a person authorised by you to receive them.

Nothing in this clause alters any rights or obligations that apply under the Australian Consumer Law.

14. ORDER CHANGES AND CANCELLATIONS

If you need to change or cancel an order, contact Jumpbooster as soon as possible.

We will try to accommodate the request where reasonably practical.

An order that has already been dispatched may need to be handled through our returns process.

Any right to cancel provided by law remains unaffected.

15. CHANGE-OF-MIND RETURNS

Jumpbooster may accept eligible change-of-mind returns in accordance with our current Warranties & Returns Policy.

Conditions may apply to voluntary change-of-mind returns, including requirements relating to:

  • the period after purchase
  • product condition
  • original packaging
  • supplied accessories and components
  • return freight.

Change-of-mind conditions do not restrict rights available where a product is faulty, defective, unsafe, not as described or otherwise fails to comply with the Australian Consumer Law.

16. AUSTRALIAN CONSUMER LAW

Goods and services supplied by Jumpbooster may come with consumer guarantees under the Australian Consumer Law.

These guarantees cannot be excluded by these Terms or by a manufacturer’s or Jumpbooster voluntary warranty.

Depending on the circumstances, consumer guarantees may include requirements that goods:

  • are of acceptable quality
  • are reasonably durable
  • are fit for a disclosed purpose
  • match their description
  • comply with applicable express representations or warranties.

Where goods fail to meet an applicable consumer guarantee, remedies can include repair, replacement, refund and, in appropriate circumstances, compensation for reasonably foreseeable loss or damage.

The remedy available depends on the circumstances and whether the failure is major or minor.

Consumer guarantee rights may continue for a reasonable period after the expiry of a stated manufacturer’s or voluntary warranty. ACCC

17. JUMPBOOSTER VOLUNTARY WARRANTIES

Jumpbooster provides voluntary warranty benefits on certain products.

These voluntary warranties are additional to Australian Consumer Law rights and do not replace, limit or exclude those rights.

The applicable warranty depends on the product.

Jumpbooster-Branded Jump Starters

Eligible Jumpbooster-branded jump starters imported and supplied by Marxgold Investments Pty Ltd trading as Jumpbooster may be covered by the Jumpbooster three-year voluntary warranty program.

The current program provides:

0–12 months: approved warrantable repair or replacement without charge.

12–24 months: approved repair or replacement under the applicable 50% customer-contribution pro-rata arrangement.

24–36 months: approved repair or replacement under the applicable 75% customer-contribution pro-rata arrangement.

Jumpbooster-Imported Accessories and Components

Non-powered accessories and components imported and supplied by Jumpbooster, including Anderson connectors, cables and similar hardware, are generally covered by a 12-month voluntary warranty against defects in materials or workmanship, subject to the applicable product conditions.

Other Products

Other products may have different warranty periods or conditions. The applicable product listing, supplied warranty information or Warranties & Returns Policy should be consulted for details.

A stated voluntary warranty period does not determine or restrict the period during which Australian Consumer Law rights may apply.

18. THIRD-PARTY BRANDED PRODUCTS

Jumpbooster sells products from third-party manufacturers and suppliers, including products sourced through Australian wholesalers and distributors.

These products are generally supplied with the applicable manufacturer’s or supplier’s voluntary warranty.

Where appropriate, Jumpbooster may assist with or administer a warranty claim through the relevant Australian manufacturer, wholesaler or distributor.

However, where you have rights against Jumpbooster as the retailer under the Australian Consumer Law, you are not required to deal only with the manufacturer or wholesaler. ACCC

19. WARRANTY ASSESSMENT AND REPAIRS

A product may need to be inspected or tested before the cause of a reported problem can be determined.

We may ask for reasonable information including:

  • proof of purchase
  • model and serial number
  • description of the problem
  • photographs or video
  • information about how the product was used.

Where a chargeable repair, pro-rata repair or non-warranty replacement is proposed, Jumpbooster will advise you of the applicable amount and obtain your approval before proceeding.

20. MISUSE, DAMAGE AND VOLUNTARY WARRANTY EXCLUSIONS

A voluntary product warranty may not cover failure or damage caused by matters such as:

  • misuse or abuse
  • accidental or physical damage
  • incorrect installation or connection
  • modification or unauthorised repair
  • use outside the stated specifications
  • incorrect charging
  • neglect
  • abnormal use
  • normal wear and tear
  • damage caused by external equipment.

Whether an exclusion applies depends on the product and circumstances.

An exclusion from a voluntary warranty does not remove any separate rights or remedies that may be available under the Australian Consumer Law.

21. PROMOTIONS, COUPONS AND DISCOUNTS

From time to time Jumpbooster may offer promotions, coupon codes, event pricing, discounts or other special offers.

Additional conditions may apply to a particular promotion and will be disclosed with the offer where relevant.

Unless otherwise stated:

  • promotional offers cannot be exchanged for cash
  • coupon codes must be used within the stated promotional period
  • offers may be limited to particular products or customers
  • only one promotional code may be applied to an order where the promotion specifies this.

Nothing in promotional terms limits rights under the Australian Consumer Law.

22. RESELLERS, BUSINESS PARTNERS AND REFERRALS

Jumpbooster works with authorised resellers, business partners and referral partners.

A customer may reach our website using a reseller or partner referral link or referral code.

Where this occurs, our system may attribute the referral to the relevant partner and apply a credit to that partner in accordance with the Jumpbooster Business Partner / Referral Program.

Referral attribution does not reduce the customer’s rights or change the customer’s purchase price unless a particular promotion expressly states otherwise.

Referral partners do not receive customer personal information through the referral system. Their access is limited to information about referral activity and applicable credit balances, as further described in our Privacy Policy.

Business partners and resellers participating in the Jumpbooster partner program may also be subject to separate Business Partner Terms. Those separate terms apply to partner-specific matters such as referral credits, wholesale arrangements and participation in the program.

23. CUSTOMER ACCOUNTS

Where customer accounts are available, you are responsible for keeping your account login information secure.

Please notify us if you believe your account has been accessed without authority.

We may suspend an account where reasonably necessary to investigate suspected fraud, security issues, unlawful activity or misuse of the website.

24. INTELLECTUAL PROPERTY

Unless otherwise stated, content on the Jumpbooster website, including text, photographs, graphics, logos, product descriptions, page designs and other material, is owned by or licensed to Jumpbooster.

You may view and use the website for personal or legitimate business purchasing purposes.

You must not reproduce, distribute, republish, commercially exploit or materially modify our website content without permission, except where permitted by law.

Third-party trademarks and brand names remain the property of their respective owners.

The Jumpbooster website may contain links to third-party websites, manufacturers, service providers or other resources.

These links may be provided for convenience or additional information.

Unless expressly stated otherwise, Jumpbooster does not control third-party websites and is not responsible for their content, availability or privacy practices.

26. PRIVACY

Personal information collected through our website, orders, forms, Product Finder and other interactions is handled in accordance with our Privacy Policy.

27. WEBSITE AVAILABILITY

We aim to keep the Jumpbooster website available and functioning correctly.

However, temporary interruptions may occur because of maintenance, technical problems, telecommunications failures, cybersecurity events or circumstances outside our reasonable control.

We may modify or update website features where reasonably necessary.

Nothing in this clause limits obligations that cannot lawfully be excluded.

28. LIABILITY

Nothing in these Terms excludes, restricts or modifies:

  • the Australian Consumer Law
  • liability that cannot lawfully be excluded
  • any statutory guarantee, right or remedy that cannot lawfully be excluded or restricted.

To the extent permitted by law, each party remains responsible for loss or damage caused by its own breach, negligence or unlawful conduct.

Jumpbooster is not responsible for loss arising solely from circumstances outside its reasonable control where we have taken reasonable steps to minimise the effect of those circumstances.

These Terms are not intended to exclude liability for reasonably foreseeable loss or damage where the Australian Consumer Law or another applicable law provides a right to compensation.

29. EVENTS OUTSIDE REASONABLE CONTROL

Neither party will be responsible for delay in performing an obligation to the extent that the delay is caused by an event genuinely outside that party’s reasonable control.

This may include significant transport disruption, natural disasters, major system outages, industrial action, government restrictions or other comparable events.

The affected party should take reasonable steps to minimise the delay.

Where an undelivered order is materially delayed and cannot reasonably be completed, we will work with the customer on an appropriate solution, which may include cancellation and refund of the affected undelivered goods.

30. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, website, products, policies or applicable law.

The version applying to a particular purchase is generally the version in effect when the order was placed, unless a change is required by law or is agreed between us.

Updated Terms will be published on this website with a revised Last updated date.

31. SEVERABILITY

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be treated as removed or limited to the extent required by law.

The remainder of the Terms will continue to operate where legally capable of doing so.

32. GOVERNING LAW

These Terms are governed by the laws applying in Queensland, Australia, together with applicable Commonwealth laws including the Australian Consumer Law.

The parties submit to the courts and tribunals having jurisdiction in Queensland, subject to any rights a customer has to bring proceedings in another jurisdiction under applicable law.
